General Terms and Conditions

1. Identity of the Entrepreneur

2. Applicability

These general terms and conditions apply to every offer by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

These terms do not limit the mandatory rights that the consumer has under applicable law. In case of conflict between these terms and mandatory consumer protection law, the consumer's mandatory rights prevail.

3. Offer and Agreement

• All offers on the website are without obligation and may be revoked at any time, unless explicitly stated otherwise.
• The offer contains an accurate and complete description of the products offered.
• An agreement is concluded at the moment the consumer accepts the offer and fulfils the corresponding conditions.
• Upon acceptance, the consumer receives an order confirmation by email.

4. Prices and Payment

• All stated prices include VAT (BTW) and are in euros.
• Shipping costs are clearly shown before the order is finalized.
• Accepted payment methods: iDEAL, Visa, Mastercard, Apple Pay, Google Pay, and Bancontact. Payments are processed securely via Pay.nl.
• The consumer is obligated to report inaccuracies in provided or stated payment details to the entrepreneur without delay.

5. Delivery

• Orders are typically processed within 1–2 business days after receipt of payment.
• If no specific delivery date is agreed, the statutory maximum delivery period of 30 days applies.
• The risk of damage and/or loss of products transfers to the consumer at the moment of delivery.

6. Right of Withdrawal

When purchasing products, the consumer has the right to dissolve the agreement without giving reasons during a period of 14 days. This cooling-off period starts on the day after the consumer or a designated third party (not the carrier) has received the product.

• During the cooling-off period, the consumer shall handle the product and its packaging with care. The consumer shall only unpack or use the product to the extent necessary to assess the nature, characteristics, and functioning of the product.
• To exercise the right of withdrawal, the consumer must inform Ummahti by means of an unequivocal statement (e.g. email to support@ummahti.net).
• After the notification, the consumer must return the product within 14 days. The direct costs of returning the product are borne by the consumer.
• Ummahti will refund all payments received from the consumer, including standard delivery costs, no later than 14 days after receiving the returned product.
• Refunds will be made using the same payment method used by the consumer, unless the consumer agrees to a different method.

The right of withdrawal may be excluded for products that are clearly personal in nature, sealed products that have been unsealed after delivery, or other statutory exceptions.

7. Warranty and Conformity

• The consumer is entitled to a product that conforms to the agreement and meets reasonable expectations (statutory warranty).
• In case of a defect, Ummahti will first assess whether repair or replacement is possible. If neither is possible within a reasonable time, the consumer is entitled to a price reduction or full refund.
• Ummahti additionally offers a 1-year commercial warranty from the date of delivery, without prejudice to the consumer's statutory rights.

8. Liability

The liability of Ummahti is limited to direct damages and in any case to the amount paid by the consumer for the product in question. Ummahti is not liable for indirect or consequential damages. This limitation does not apply in cases of intent or gross negligence, nor does it limit any mandatory statutory liability.

9. Personal Data

Ummahti processes personal data in accordance with its privacy policy, available at ummahti.net/privacy. Personal data will not be shared with third parties other than as necessary for order processing and delivery.

10. Complaints

Complaints about products or services can be submitted to support@ummahti.net.

Ummahti will respond to complaints as quickly as possible, but no later than within 14 days of receipt.

Consumers in the EU can also file a complaint via the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

11. Amendments

Ummahti reserves the right to amend these general terms and conditions. Changes take effect 30 days after publication on the website. For existing orders, the terms that applied at the time of the order remain in effect.

12. Applicable Law

These general terms and conditions are governed by Dutch law. If the consumer is a resident of another EU member state, they also benefit from any mandatory provisions of the consumer protection law of their country of residence.
